Terms of Service
Summary
This summary is for convenience. The full Terms below are what apply.
- These Terms are a binding agreement between you and Polyer.
- You must be at least 16 years old to use Polyer.
- You own what you deploy, and you are responsible for it and for your applications' users.
- You may not use Polyer for the activities listed in the Acceptable Use Policy.
- Polyer supports prepaid wallet credit and paid subscriptions. Subscriptions renew automatically unless you cancel renewal. Credit is not refundable.
- Wallet-funded services stop when available funds run out. Supported subscriptions can bill usage beyond the included allowance and wallet balance; spending limits still apply. We do not guarantee to keep the data of workspaces that remain suspended for a long time.
- Polyer is provided "as is". Our liability is limited.
- We may change these Terms. We will tell you before material changes take effect.
Full terms
Welcome to Polyer. These Terms of Service ("Terms") govern your use of the website at https://polyer.io, the Polyer console and API, and the hosting, build, database, storage, networking and related services we provide (together, the "Services"). These Terms are a binding contract between you and Polyer ("Polyer", "we" or "us").
These Terms include our Privacy Policy and Acceptable Use Policy. By creating an account, topping up credit or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
If you are accepting these Terms on behalf of an organization, you confirm that you are authorized to bind it, and "you" means that organization.
Will these Terms change?
We may change these Terms as the Services evolve. For material changes, we will notify you by email or through the Services before the changes take effect. If you do not agree to the new Terms, stop using the Services and close your account before they take effect. If you continue to use the Services after that, you accept the updated Terms.
Who can use Polyer?
You must be at least 16 years old and able to form a binding contract. You may not use the Services if the law, including applicable sanctions and export control laws, prohibits you from doing so.
Your account
- You can sign up with an email address and password, or with Google or GitHub. If you use Google or GitHub, you authorize us to receive the account information they share with us, as described in the Privacy Policy.
- Keep your account information accurate and up to date.
- Keep your password, passkeys, two-factor codes and API keys secure. You are responsible for all activity in your account, including activity through your API keys. Tell us at help@polyer.io if you suspect unauthorized access.
- Do not share an account or transfer it to someone else without our written permission.
- Workspaces. Resources and billing belong to a workspace. The owners of a workspace are responsible for that workspace, for its members and for the charges it incurs. Owners decide who can access a workspace and what each member can do. Members can view or change resources according to their role.
What are the rules?
You must use the Services lawfully and in line with the Acceptable Use Policy. You must not reverse engineer the Services except where the law allows it, and you must not try to bypass the quotas, isolation, security or billing mechanisms of the Services. Violations may lead to removal of content and suspension or termination of your account.
Your content
"Your Content" means the source code, container images, configuration, environment variables, databases, files, domains, logs and other material you or your applications put into the Services.
- You own Your Content. We do not claim ownership of it.
- License to operate the Services. You grant us a worldwide, non-exclusive license to host, store, copy, transmit, build, run, back up and modify (for technical purposes only, such as building and packaging) Your Content as needed to provide, secure and support the Services. This license ends when Your Content is deleted from our systems, including backups.
- Public templates. If you publish a template to the public template catalog, you grant us and other users a worldwide, non-exclusive, royalty-free license to display, copy and deploy that template through the Services. This continues after you unpublish it for deployments already made from it. The template is shown publicly with your workspace's name as its author. Default values you include in a template are copied into every project deployed from it, so never include secrets. Make sure you have the rights to everything the template includes, and that any third-party software in it is used under its own license.
- Our access. We access Your Content only when it is needed to provide and maintain the Services, to respond to your support request, to investigate security incidents or violations of these Terms, or to comply with the law. Administrative access is logged.
- Your responsibility. You are responsible for Your Content and for the applications you run, including their compliance with the law and the way they handle the personal data of their own users. When your applications process personal data on the Services, you are the controller of that data and we process it on your behalf.
- Backups. We back up our platform to recover from failures, but those backups are not a service we offer to you, and we do not guarantee that any specific data can be restored. Backup features you turn on in the console are best effort. Keep your own copies of data that is important to you.
Fees and payment
- Wallet credit. You can top up prepaid credit for a workspace. Wallet-funded usage and existing wallet-funded plan fees are deducted from that balance. Adding credit does not start or change a subscription. All amounts are in US dollars. Our current prices are published on our pricing page.
- Plans. A paid plan fee includes the same amount of usage credit for its billing period; it is a minimum charge, not a cap on usage costs. Included usage credit that you do not use does not carry over. A provider subscription starts after you choose a plan and its payment is confirmed. It renews automatically each billing cycle unless you cancel renewal; the console shows its cycle dates and cancellation state. Existing wallet-funded plans retain their 30-day billing periods, with the plan fee deducted from wallet credit at the start. Upgrades are charged pro rata and take effect after any required payment is confirmed. Downgrades take effect at the start of the next period.
- Usage. Compute, memory, storage, public network traffic and other resources are measured continuously and charged as they are used, at the published prices for the region where they run. Applicable, unexpired gifts offset usage first under their grant rules, followed by included plan credit and wallet credit. On subscription channels that support usage billing, any remaining usage is billed through your subscription. Spending limits still apply.
- Payment providers. Payments are handled by third-party providers. When you pay through Creem or Polar, that provider acts as the merchant of record and reseller for that transaction, and its terms and privacy policy also apply. When you pay through Stripe, Stripe processes the payment on our behalf under its own terms. We do not store your full card details.
- Taxes. Prices do not include taxes. Applicable taxes are calculated and collected at checkout by the payment provider and are not added to your credit.
- Automatic top-up. If you turn on automatic top-up, you authorize us, through the payment provider, to charge your saved payment method for the amount you selected whenever your balance falls below the threshold you set, until you turn it off. We may turn automatic top-up off after repeated failed payments.
- Spending limits and alerts. Workspace owners can set a spending limit and usage alerts. When usage reaches the spending limit, the workspace is suspended as described below.
- Free policy. Once enabled for your account, a verified account's one personal workspace receives $1 of Free allowance per fixed 30-day cycle, without rollover or backfilling missed cycles. A trial that started before this policy keeps its original expiry. Free does not require a card. Extra workspaces receive no additional free allowance and require their own Pro subscription. Paid subscriptions require your confirmation; prices and existing wallet credit do not change under this policy. Gifts have no cash value and do not pay subscription fees.
- Free, promotional and referral credit. Credit granted through trials, promotions, promotional codes or referrals has no cash value, cannot be transferred, and expires when the account or workspace it was granted to is closed. Referral rewards are subject to the conditions shown in the console. We may change, limit or end these offers, and we may revoke credit obtained by abuse, such as by creating multiple accounts or referring yourself.
- No refunds. Credit you have purchased and plan fees are not refundable and cannot be exchanged for cash, including when you delete a workspace or close your account, or when we suspend or terminate your account for violating these Terms. The exceptions are duplicate charges and charges caused by our billing errors, which we will refund, and any refund you are entitled to under laws that cannot be waived. To report a billing problem, email help@polyer.io.
- Disputes and chargebacks. If you think a charge is wrong, contact us first. If a payment is reversed or charged back, we may suspend the affected workspace until the matter is resolved.
- Price changes. We may change our prices. Price increases take effect no earlier than 14 days after we publish them on our pricing page and notify you.
What happens when my credit runs out?
A wallet-funded workspace is suspended when it cannot pay its plan fee or usage. A supported usage-billed subscription can continue beyond its included allowance and wallet balance; unpaid subscription fees or a reached spending limit can still suspend it. Suspension stops running services and blocks deployment. Its data stays in place but is locked: you cannot browse or download data, open a shell or read runtime logs while the restriction applies. Adding funds, confirming the required subscription payment or raising a reached spending limit can restore eligible services. This does not start manually stopped services or remove unrelated restrictions; Trial and Free automatic resumption also follows the setting described below.
For resources created after a workspace joins the new Trial/Free retention policy, a pause caused by exhausted Free funds starts a fixed 30-day data-retention period shown in Billing. A valid allowance or confirmed payment before permanent cleanup is authorized cancels that cleanup. Payment after permanent cleanup is authorized cannot restore those old resources. Automatic resumption respects your setting and does not restart manually stopped services or lift unrelated account restrictions. Earlier resources and existing balances are not retroactively placed under this deadline.
Suspending a workspace does not delete its data right away. However, we do not guarantee that we will keep the data of a workspace that remains suspended for a long period, and we may delete it. We will try to notify the workspace owners by email before we do so.
Changes to the Services
We are constantly improving the Services. We may add, change, limit or remove features, regions or plans. If we discontinue a Service you are actively using, we will give you reasonable notice and, where practical, a way to export Your Content.
Third-party services
The Services connect to third-party services such as Google, GitHub, Cloudflare and our payment providers, and to integrations you configure, such as chat webhooks. Templates may include third-party software. Your use of those services and software is governed by their own terms. We are not responsible for third-party services, and features that depend on them may stop working if they change or become unavailable.
Reporting illegal content and copyright infringement
If you believe that content hosted on the Services is illegal or infringes your copyright or other rights, email help@polyer.io with:
- the URL or other information that lets us locate the content;
- a description of the content and why you believe it is illegal or infringing, including, for copyright claims, the work you believe is infringed;
- your name and contact details, and if you act for a rights holder, who that is; and
- a statement that you believe in good faith that the information in your notice is accurate and complete.
We will review notices promptly and may remove or disable access to the content. We will tell the affected user what we did and why, unless the law prevents it. If you believe your content was removed by mistake, you can reply with an explanation, and we will reconsider. We will terminate the accounts of repeat infringers in appropriate circumstances.
Suspension and termination
You can stop using the Services at any time by deleting your services and workspaces, or by deleting your account in account settings. Account deletion takes effect as soon as you confirm it.
We may suspend or terminate your access to all or part of the Services, with or without notice, if you violate these Terms or the Acceptable Use Policy, if your use creates a security, legal or operational risk for us or others, if a payment is reversed, or if we are required to do so by law. Where practical and appropriate, we will notify you in advance and give you an opportunity to address the issue.
When your account is terminated, your services stop and Your Content may be deleted, and any remaining credit is forfeited as described in "Fees and payment". If you deleted your account by mistake, contact us immediately at help@polyer.io. We will try to help, but cannot promise that anything can be recovered.
Provisions that by their nature should survive termination will survive, including payment obligations, the license for public templates, disclaimers, limitations of liability, indemnity and dispute provisions.
